RICO Complaint November 1994

This is an accurate version of the draft RICO complaint. The version on www.laborers.org is not accurate. This version is copyrighted by Laborers for JUSTICE and is not to be rebroadcast on any other web site. I did not spend countless hours assuring its accuracy to have some thief in the night come in to make a copy and then publish it on his site and claim he did all the work involved in getting the document scanned accurately. I might as well work and expect him to steal my paycheck. 

This is not the draft of the RICO complaint that DOJ will attach to the contingent consent decree in the event it is ever filed. That RICO complaint will not be a draft but the actual thing. Coia sent me a copy of the draft complaint that is referred to in the "Agreement" as the "attached complaint" the parties have agreed to file. This is referred to as the "sanitized" complaint.

Neither complaint was ever provided by LIUNA to the membership. The 1996 Election officer's order for LIUNA to make it available to the members was appealed to Vaira who ruled LIUNA did  not have to produce it, thereby discouraging reformers who mistakenly thought the Union was going to be more forthcoming in informing the membership of matters essential to their right of self governance. DOJ aided and abetted this coverup. LIUNA GEB Attorney, Robert Luskin, to his credit provided me a copy after LIUNA Inspector General GOW wrote back  saying it was not his duty to provide information to members on union corruption. I was hoping Gow would send it to me so I and others would learn about the kinds of corruption he is supposed to investigate and like, maybe, help him in his efforts. 

The January 18, 2000 agreement between LIUNA and DOJ provides that the "sanitized " RICO complaint and agreed upon consent decree will not be filed and that the threat of their filing has been removed.
